According to Sheeran's attorneys, the lawsuit was void because  elements that were similar on the two tracks were not unique enough to be covered by copyright law.

Citing a  number of other songs, including "Since I Lost My Baby," as examples of tracks with similar elements, his legal team argued that the lawsuit was irrelevant.

However, the US District Judge,” and that Sheeran must face a jury to resolve the matter. The judge cited a disagreement among music experts as the reason for his decision. "There is no clear rule that the combination of two unprotected items is not numerous enough to form an original work," the judge wrote.

"A work may be copyrighted even though it is entirely a compilation of unprotected elements." Although the two musical compositions are not identical, a jury might find that the overlap between the songs' combination of chord progression and harmonic rhythm is very close, added Stanton.
